GENERAL CONTRACTUAL CONDITIONS

Introduction.

These general terms and conditions for contracting the services of the website www.caminoexperiences.com hereinafter WEBSITE shall be governed by Spanish legislation, and the offer and formalization of contracts shall be carried out in Spanish.

Access to the website.

The USER may freely access the WEBSITE. The USER declares that all information provided by him when making reservations is true and complete.

General information.

These General Conditions are subject to the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the defense of Consumers and Users and other laws, Law 7/1998, of April 13, on General Conditions of Contracting and other current provisions.


The portal reserves the right to modify, limit, or cancel the terms and conditions applicable to the aforementioned website. In any case, the conditions in effect when the customer made the booking will apply, or any subsequent conditions if they are more favorable to the consumer's interests.


CAMINO CULINARY EXPERIENCES reserves the right to deny or withdraw access to the Portal and/or the Services, at any time and without prior notice to those USERS who fail to comply with these General Conditions.


These terms and conditions shall be governed by Spanish law. The courts of Galicia shall have jurisdiction over any dispute arising from these terms and conditions, except where, pursuant to Royal Legislative Decree 1/2007 of 16 November, which approves the consolidated text of the General Law for the Defense of Consumers and Users, the other party is a consumer or user, in which case the courts of the consumer's domicile shall have jurisdiction.

Content and responsibility.

CAMINO CULINARY EXPERIENCES operates the WEBSITE and, in particular, offers and, where appropriate, supplies the content, products and services to the USER visiting the WEBSITE on behalf of and for the account of renowned tour operators.

In this regard, CAMINO CULINARY EXPERIENCES has simply included the service on the WEBSITE. Unless explicitly stated otherwise, under no circumstances may it be understood that CAMINO CULINARY EXPERIENCES directly offers flights, car rental services, package holidays, hotel and bus reservations, or similar tourist services.

The purchase of products/services through the WEBSITE signifies the USER's acceptance of (i) these general conditions, (ii) the specific conditions applicable to the type of product/service to be contracted and (iii) the conditions of the product/service provider.


In particular, in the case of low-cost airlines, the use by the customer of the WEBSITE for the purpose of locating flights for the purpose of booking implies the direct submission of the customer to the general conditions of said airlines and the general conditions of the websites of each of them, including those corresponding to the protection of personal data.


The USER agrees to accept and abide by the purchase terms and conditions established by the supplier with whom the booking is made. These conditions may include the payment of any applicable fees and compliance with any rules and restrictions regarding the availability of rates, products, or services.


CAMINO CULINARY EXPERIENCES makes available to consumers and users an information program or brochure that contains in writing the corresponding offer on the package tour and that must include clear, understandable and precise information on the destinations and means of transport, mentioning their characteristics and class, duration, itinerary and travel schedule.

The suppliers of products or services and the organizers/wholesalers who organize the package tour, each within the scope of their respective obligations, will be responsible to the USER for compliance with the obligations arising from the regulations in force and the conditions of sale of each of the products and services or package tours that are contracted, without CAMINO CULINARY EXPERIENCES assuming any obligation or responsibility with respect to those products or services that it does not provide directly.


The traveler is responsible for complying with government requirements for departure, entry, and other documentation. CAMINO CULINARY EXPERIENCES may incorporate additional specific conditions, which will be stated on the website.

Purchase processes and payment methods.

On the WEBSITE, reservations can be made in Spanish. Most fields are free-form, so the WEBSITE has no means to identify and correct errors in data entry; therefore, the USER is responsible for any errors made when entering said data.


The document formalizing the contract through which the client purchases any tourism product or service via the WEBSITE will be sent to the USER by email. This email will contain information regarding the products and/or services purchased, their booking reference number, all payment instructions, cancellation policy, other useful information, and, if applicable, the travel documents.


The purchase of any product will only be effective when CAMINO CULINARY EXPERIENCES makes a valid charge according to the chosen payment method, and until that moment CAMINO CULINARY EXPERIENCES may cancel the purchase.


The available payment methods are:


PAYMENT BY CREDIT OR DEBIT CARD. With debit cards, the charged amount is automatically withdrawn from the associated account. With credit cards, the USER can access funds even without sufficient balance in the associated account, and the amount is typically charged at the beginning of the month following the purchase.

STANDARD BANK TRANSFER. Once you have made your reservation on our website, you must make a transfer within the next 24 business hours for the agreed amount. In the transfer details, please include the booking reference number that we will provide you upon completion of your reservation. Please send proof of transfer to the following email address: antonio@caminoexperiences.com


PAYPAL. We connect you to PayPal, where you will need to log in with your account to proceed with the payment. We recommend paying with PayPal as it is one of the most secure payment methods.


DIRECT PAYMENT AT THE HOTEL. The USER may make the payment directly at the hotel when specifically provided for that type of service.

CAMINO CULINARY EXPERIENCES will request your credit card details ONLY AS A GUARANTEE. The hotel may only use this information to charge cancellation fees in cases of reservation cancellation or no-show at the hotel.


Not all of these payment options are always available; it will depend on the type of product and how far in advance you make the reservation.


Requesting a reservation implies a commitment from the customer to authorize the charge for the full amount of the product, service or package tour contracted.

Right of withdrawal.

It is the power that the user has to terminate a contract in certain cases without needing to justify their decision or assume any penalty.


Pursuant to Article 103(l) of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, the right of withdrawal shall not apply to contracts relating to the supply of accommodation services for purposes other than serving as a dwelling, transport of goods, rental of vehicles, food or services related to leisure activities, if the contracts provide for a specific date or period of execution.

Regarding passenger transport, according to Article 93 k) of Royal Legislative Decree 1/2007, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users, the regulations governing distance selling (with the exception of Article 98.2) do not apply to passenger transport service contracts. Therefore, the right of withdrawal does not apply to reservations for passenger transport services. Thus, if the USER wishes to cancel the purchased tickets, the cancellation policy of the relevant company will apply.


With regard to package holidays, Article 160 of the same legal text provides that the USER may at any time cancel the services requested or contracted, having the right to a refund of the amounts paid, but must compensate the organizer or the retailer in the following amounts, unless such resolution takes place due to force majeure
Cancellation of the trip, for any reason not attributable to the consumer, entitles them to terminate the contract with the rights provided.


If the trip cancellation is communicated within two months prior to departure, CAMINO CULINARY EXPERIENCES must pay the consumer compensation based on the time remaining until departure, which will be at least:


a) 5% of the trip price if it occurs more than 15 days and less than 2 months in advance.


b) 10% of the trip price, if it occurs between 15 and 3 days in advance.


c) 25% of the trip price, if it occurs within 48 hours prior to departure.


If the consumer and user does not appear at the departure, they are obliged to pay the total amount of the trip, paying, if applicable, any outstanding amounts unless otherwise agreed between the parties.


In the event that the package tour is subject to special economic conditions of contracting, such as chartering of aircraft, ships or special fares, the cancellation fees will be established in accordance with the conditions agreed between the parties.


There is no obligation to provide compensation in the following cases:


a) When the cancellation is due to the number of registered people being less than required in the brochure or in the contract for the package tour.


In this case, the agency must notify the consumer of the cancellation in writing before the deadline set in the brochure or contract.
Alternatively, the agency must notify the cancellation at least ten days before the departure date.


b) When the cancellation of the trip is due to force majeure. Force majeure refers to circumstances beyond the agency's control, abnormal and unforeseeable, the consequences of which could not have been avoided despite having acted with due diligence.

Intellectual and industrial property.

CAMINO CULINARY EXPERIENCES, either directly or as an assignee, owns all intellectual and industrial property rights to its website, as well as the elements contained therein (including, but not limited to, images, sound, audio, video, software or texts; trademarks or logos, color combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), which are owned by CAMINO CULINARY EXPERIENCES or its licensors. All rights reserved. Pursuant to Articles 8 and 32.1, second paragraph, of the Intellectual Property Law, the reproduction, distribution, and public communication, including making available, of all or part of the content of this website for commercial purposes, in any medium and by any technical means, is expressly prohibited without the authorization of CAMINO CULINARY EXPERIENCES.

The USER agrees to respect the Intellectual and Industrial Property rights held by CAMINO CULINARY EXPERIENCES. The USER may view the elements of the portal and even print, copy, and store them on their computer's hard drive or any other physical medium, provided that it is solely and exclusively for their personal and private use. The USER must refrain from deleting, altering, circumventing, or manipulating any protection device or security system installed on the CAMINO CULINARY EXPERIENCES website.
